Terms of Service for ConvoBolt

1. Introduction

Welcome to ConvoBolt ("ConvoBolt," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our software-as-a-service (SaaS) platform, which provides AI-assisted comment replies for YouTube channels (the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Our Service integrates with YouTube API Services. By using ConvoBolt, you acknowledge and agree to be bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms.

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You must be at least 18 years old to create an account and use the Service.

4. Subscriptions & Billing

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or ConvoBolt cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting ConvoBolt customer support.

A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide ConvoBolt with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize ConvoBolt to charge all Subscription fees incurred through your account to any such payment instruments.

5. Refunds

Payments for subscriptions, top-ups, or any other Service features are non-refundable except where required by applicable law. Please review our Refund Policy for further details.

All content, features, and functionality provided through the Service are the exclusive property of ConvoBolt or its licensors. This includes, but is not limited to, text, graphics, logos, software, AI models, and algorithms. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain ownership of any content you create or provide through the Service, including comments and replies. However, by using the Service, you grant ConvoBolt a limited license to use, store, and process your content solely for the purpose of providing the Service.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease, and we may delete your account and all associated data.

You may terminate your account at any time by canceling your subscription through your account settings or by contacting customer support. Termination does not relieve you of any obligations to pay accrued fees.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties of any kind, express or implied, regarding the operation or availability of the Service, or the information, content, or materials included. We specifically disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not warrant the accuracy, completeness, or reliability of any AI-generated content.

10. Limitation of Liability

To the maximum extent permitted by law, ConvoBolt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the three (3) months immediately preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless ConvoBolt and its affiliates, licensors, and service providers from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you by email and/or by posting a notice within the Service prior to the changes taking effect. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Florida, and you consent to the jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and ConvoBolt regarding the Service and supersede all prior agreements and understandings.
